Due to a lack of transparency in prices at hospitals, The Centers for Medicare & Medicaid Services (or CMS) has begun sending out warnings. This could eventually lead to civil monetary penalties if CMS should decide to pursue that angle.

Penalties levied by CMS cap at $300 per day, no matter the number of violations.

Hospital transparency is in regards to the publishing of an easy-to-read list of standard hospital charges. Hospitals are hesitant to comply, as rates are often negotiated with third parties.

While seemingly in favor of the transparency rule, the Biden administration has remained silent about the rule.
